Abstract

To perform a thorough analysis, based on the Colombian legal system, perceived as fundamental rights, is seen as fundamental rights, and, yes, all the dogmatic part of the Constitution of 1991, is subject to the political volition of those in power, and if it is true that some rights, such as second and third generation, are planned and progressive realization of the fact remains that no efforts are needed to get to achieve them.

The spirit of the social state of right is that all these social guarantees are fully met and that gaps of inequality and inequity are increasingly less, but with the new concept in our legal system of Fiscal sustainability, it is very unlikely even to try to carry out development plans, since to hold all aspects and fiscal sustainability clearly economics are denying the social state of rights.
