Abstract

This article analyzes the doctrinal construction on a new theory of State, where the protection of the Environment is tended, together with the protection of the fundamental rights of the people, this new model has the purpose of facing the great world problem of climate change. The public administration plays a fundamental role within this form of State, in the sense that it is the great executor of public policies, plans, programs and all current legal regulations, that is, it is the one who has the task of putting everything into action. the regulatory scaffolding and it is through the evaluative study of the same that it is possible to elucidate if the aims of the State are fulfilled or not. The administration can be understood in a very broad sense, where central level entities, territorial level and decentralized entities are related, but for the purposes of this research the study will be approached only from the territorial level, specifically from the functional perspective of the Municipalities versus the construction of the Environmental State of Law, for which a legal methodology was used, with a qualitative approach and an exploratory level.
